Today, Rachel Rabinovitch, a human resources consultant in Vancouver, provides an overview of dental HR policies.
Question: What are three of the most common mistakes dental professionals make when it comes to both navigating and understanding employment law?
Rachel Rabinovitch: Three of the most common mistakes we see are:
- General leave management, what to do when employees come back from leave, and, most specifically, changing their jobs improperly
- General mistreatment of employees, which includes health and safety throughout COVID-19, application of policies, and a lack of proper procedures
- Not complying with the Employment Standards Act or Human Rights Code
Q: What employment law-related pitfalls are dental professionals typically privy to?
RR: With leave management – constructive or wrongful dismissal. Contravening ESA and Human Rights are also major liabilities that dental professionals are typically privy to.
Q: What are the benefits of dental professionals understanding and staying on top of new employment regulations?
RR: The top benefits of dental professionals understanding and staying on top of new employment regulations are:
- Positive reputation within employees’ professional circles and industry in general
- Avoiding expensive legal bills in defending their position or through settlements and/or litigation
- Positive workplace culture; happier employees
- Reduced turnover (because turnover is extremely costly and time consuming)
Q: What advice would you give to new dental professionals looking to better comprehend employment law?
RR: My advice for dental professionals looking to better comprehend employment law would be to:
- Familiarize themselves with the Employment Standards Act in the jurisdictions they practice in (as well as the Human Rights Code)
- Speak with an HR Consultant or hire an internal HR professional to help navigate employment relationships
- Talk to an employment lawyer on specific cases, such as creating or changing employment agreements, terminations/severance pay, major job changes, and implementing restrictive COVID-19/communicable disease prevention policies, to name a few
