Dave O’Neill has a civil litigation practice focused on personal injury, residential tenancy, and employment law. Dave energetically works with Tom and his colleagues to provide excellence throughout the legal process.

Dave has extensive trial experience representing injured clients who require the adjudicative process to ensure they received fair compensation for their injuries. He is particularly skilled at articulating the ways in which his clients’ injuries impact all aspects of their daily lives.

In his litigation practice, Dave has acted for clients suffering from brain injuries, cognitive impairments, concussions, chronic pain syndrome, fractures, spinal injuries, soft tissue damage, chronic fatigue syndrome, fibromyalgia, myalgic encephalomyelitis, and psychological injuries.

In Dave’s residential tenancy practice he assists clients in understanding their rights and responsibilities at the start, during and end of a tenancy. Dave has experience navigating the ins and outs of administrative bodies such as the Residential Tenancy Branch and civil resolutions tribunals.

In his employment law practice he advises employees on wrongful dismissal and severance packages.

Dave has appeared before the Supreme Court of British Columbia, the Civil Resolution Tribunal, Residential Tenancy Tribunal, and has represented clients in settlement negotiations and mediations.

Dave enjoys intellectual challenges in his free time. He is well read on many topics and is an avid participant in trivia nights. He enjoys skiing, squash, travelling and live theatre.

  • Successfully acted for a retired teacher whose chronic fatigue syndrome irreparably impacted all aspects of her life. Obtained a judgment well in excess of ICBC’s offer, including an award that acknowledged the severe loss of housekeeping capacity for this aged client. Gabert v. Krist, 2018 BCSC 2109
  • Successfully acted for a teacher in a case where the insurer, ICBC, was insisting on a low level of compensation based on the fact that the teacher’s car had only experienced a small amount of damage. Obtained a judgment significantly higher than what had been offered by the insurer. This case is frequently cited in court a precedent for chronic non-disabling neck pain. Blackman v.   • Successfully acted for a pest control technician in protracted litigation over ten years where ultimately the final amount awarded our client significantly exceeded the plaintiff’s offer to settle. Also obtained for the client a loss of earnings capacity award despite vigorous opposition by ICBC. Healey v Chung, 2019 BCSC 1429
  • Successfully acted for a client who suffered cognitive, emotional, and physical injuries as a result of two motor vehicle accidents. As a result of the accidents the client was rendered disabled from her job. Obtained a judgment well in excess of ICBC’s offer and that provided the needed resources for our client to manage her life. Amaral v. Glasser, 2020 BCSC 639
